BullTrading Indicator License Agreement
By subscribing and or using the BullTrading Easy SMC Indicators, you (“Licensee”) agree to the following terms and conditions set forth by Akuma Epic Studios and BullTrading Asset Management SAPI de CV (“Licensor”):
1. License Grant
The Licensor grants the Licensee a non-exclusive, non-transferable, and revocable license to use the BullTrading Easy SMC Indicators solely for personal use and proprietary firm trading. This license is subject to the terms and conditions set forth in this Agreement and applicable laws of the United Mexican States and the United Arab Emirates.
2. Permitted Uses
The Licensee may use the indicators only for:
• Personal Trading
• Trading within a Proprietary Trading Firm
3. Prohibited Uses
A. Unauthorised Purposes
• Using the indicators for any purpose other than personal use or authorized proprietary trading
B. Dissemination of Signals
• Sharing signals generated by the indicators through any electronic medium or platform, whether for free or commercial purposes.
C. Competitive Employment
• Using the indicators while employed by or associated with a fund, investment institution, or any entity that may compete directly or indirectly with the Licensor’s business.
D. Reverse Engineering
• Reverse engineering, decompiling, or attempting to derive the source code of the indicators.
4. Term and Termination
A. Duration
• This Agreement shall commence on the subscription date and continue until terminated by either party with thirty (30) days’ written notice.
A. Immediate Termination
• The Licensor may terminate this Agreement immediately upon the Licensee’s breach of any terms herein.
C. Non-Payment and Violations
• The license will also be terminated if there is non-payment or if the Licensee violates any conditions of this Agreement.
D. Compliance with UAE and Mexican Law
• Upon termination of the Agreement, the Licensee must cease all use of the indicators and destroy any copies of related materials in their possession, in compliance with UAE and Mexican law.
5. Ownership and Confidentiality
A. Exclusive Property
• The indicators, including all associated intellectual property rights, are and shall remain the exclusive property of the Licensor.
B. Confidentiality Obligations
• The Licensee agrees to maintain the confidentiality of the indicators and not to disclose or distribute them to any third party.
C. Data Protection Compliance
• The Licensee must comply with applicable data protection regulations, including the UAE Personal Data Protection Law (PDPL) and Mexico’s Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP), when handling any data provided by the Licensor.
6. Licensor’s Responsibility
A. Access Provision
• The Licensor commits to enabling access to the TradingView indicators within 12 to 48 hours after payment confirmation.
B. Limitation of Liability
• The Licensor shall not be liable for delays caused by factors beyond its control, including but not limited to third-party service interruptions, technical issues on the TradingView platform, or any other external factors.
7. Payment Terms and Refund Policy
A. Payment Structure
Option 1: Easy SMC Quarterly Ownership Plan
• Quarterly Payment:
• The Licensee agrees to pay £419.70 every three (3) months.
• Total Duration:
• The Licensee must complete six (6) consecutive quarterly payments over a period of eighteen (18) months to acquire lifetime ownership of the indicators.
• Ownership Transfer:
• Upon completion of all six payments, the Licensee will obtain lifetime ownership of the indicators.
• Cancellation Policy:
• The Licensee may cancel the subscription at any time during the payment period.
• Important: To gain lifetime ownership, all six (6) payments must be completed consecutively. Canceling before completing all payments will result in the Licensee not acquiring lifetime ownership rights, and previous payments cannot be applied toward future purchases.
• Access to the indicators will continue until the end of the paid period.
Option 2: Easy SMC Lifetime Access
• One-Time Investment:
• A single payment of £1,990 grants the Licensee immediate lifetime access and ownership of the indicators.
• Savings:
• This option saves the Licensee £528.20 compared to the total cost of the Easy SMC Quarterly Ownership Plan
b. Refund Policy
• No Refunds:
• All sales are final, and no refunds will be accepted for any payments made, including the quarterly payments and the one-time investment.
• Consumer Protection Notice:
• This refund policy does not affect any statutory rights that the Licensee may have under the consumer protection laws of the UAE or Mexico, where applicable.
8. Limitation of Liability
The Licensor shall not be liable for any direct, indirect, incidental, or consequential damages arising out of or related to the use of the indicators, except where such limitation of liability is prohibited by applicable law.
A. UAE and Mexican Law Compliance
• This clause is subject to the limitations and exceptions provided under the laws of the United Mexican States and the United Arab Emirates, including but not limited to DIFC and local consumer protection laws
9. Stripe Terms of Use
A. Payment Processing
• Payments for indicator subscriptions are processed through Stripe, a third-party payment service provider.
B. Agreement to Stripe’s Terms
• The Licensee agrees that the use of Stripe is subject to Stripe’s terms of service and privacy policies, which may include liability limitations, dispute resolution rules, and other terms that protect both Stripe and the Licensor.
C. Licensor’s Disclaimer
• The Licensor is not responsible for errors, disputes, or issues related to payment processing through Stripe. Any claim related to payment processing must be directed to Stripe.
D. Stripe’s Role
• The Licensee acknowledges that Stripe is a separate entity from the Licensor, and any issues related to payment processing, refunds, or data breaches should be resolved according to Stripe’s policies.
10. Governing Law and Dispute Resolution
A. Applicable Law
• This Agreement shall be governed by and construed in accordance with the laws of the United Mexican States and the United Arab Emirates.
B. Jurisdiction
• Any disputes arising out of or in connection with this Agreement shall be subject to the non-exclusive jurisdiction of the courts of the United Mexican States and the UAE, including the Dubai International Financial Centre (DIFC) for matters pertaining to the UAE.
C. Dispute Resolution Clause
• In case of any dispute, the parties agree to attempt to resolve the matter through mediation or arbitration in accordance with the rules of the DIFC or relevant Mexican arbitration bodies before resorting to litigation.
11. Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, with respect to the subject matter hereof
12. Compliance with Local Laws
The Licensee agrees to comply with all applicable laws and regulations in the jurisdictions in which they operate, including but not limited to the United Mexican States and the United Arab Emirates. Any breach of such laws by the Licensee may result in immediate termination of this Agreement.
Additional Notes
A. Clarification on Usage Rights
• Failure to complete all payments as per the Easy SMC Quarterly Ownership Plan will result in the Licensee not obtaining lifetime ownership of the indicators.
• Access to the indicators will be terminated at the end of the paid period if the subscription is canceled before completing the six (6) consecutive quarterly payments.
• Previous payments cannot be applied toward future purchases or ownership.
B. No Transfer of License
• The license granted herein is personal to the Licensee and may not be assigned or transferred to any other person or entity without the prior written consent of the Licensor.
C. Amendments
• The Licensor reserves the right to amend the terms of this Agreement upon providing the Licensee with thirty (30) days’ written notice. Continued use of the indicators after such amendments constitutes acceptance of the new terms.

Acceptance
By proceeding with the subscription, the Licensee acknowledges that they have read, understood, and agreed to be bound by the terms and conditions of this License Agreement.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement as of the subscription date.
